What Terms and Conditions May Apply Is About

The documentary begins with a simple question: what is in the agreements we accept online. Nobody reads them, and would not understand them if they did. The film shows one by one what those texts give away: location records, the content of messages, search history, and how all of it moves between companies and the state. Cullen Hoback directs. Its most concrete section is the length of user agreements; reading everything an average person accepts in a year would take weeks, and the film does that arithmetic. The narrative describes how surveillance law widened after 11 September and how corporate data is shared at the request of government. What is interesting is the timing. It was finished in 2013, just before the Snowden documents were published, and much of what it describes was confirmed by those documents a few months later. Hoback's method is direct; he tries to reach Mark Zuckerberg in the street, and that passage is the most cited in the film. Its limit is that it proposes no solution. The narrative lists the problems and says nothing concrete about what to do. Some of the information has aged; the policies of the companies in question have changed many times since. Who it is for: viewers who follow documentaries on privacy and technology policy. Who it is not for: the structure is scattered, the tone is alarmist at times, and the technical explanations are shallow.
